Article 12: Establishment and maintenance of due diligence systems, reporting and record keeping

Operators shall establish and maintain a due diligence system to ensure compliance with Article 3. That due diligence system shall be reviewed at least annually and updated to account for new developments.

Operators, except for SMEs and natural persons, shall publicly report on their due diligence system, including the steps taken to comply with the requirements set out in Article 3, on an annual basis.

Operators shall keep records of the information and documentation required under this Regulation for at least five years and shall make them available to the competent authorities upon request.
